These Terms & Conditions (“Terms”) govern your participation in any services provided by Lux Coaching (“we”, “us”, “our”). By purchasing, subscribing to, accessing, or participating in any Lux Coaching service, you agree to be bound by these Terms.
1. Services & Scope
Lux Coaching provides online fitness coaching, exercise programming, nutrition guidance, habit coaching, education, accountability, and support services. Services may be delivered via digital platforms including (but not limited to) Everfit, Stripe, Zoom, Loom, email, and other third-party software.
Coaching services are educational and supportive in nature and are not medical care, diagnosis, or treatment. Nothing provided by Lux Coaching replaces advice from a qualified medical or allied health professional.
2. Eligibility, Screening & Informed Consent
You must complete all required intake forms and pre-exercise screening prior to commencing coaching. You confirm that all information provided is accurate and complete and agree to notify Lux Coaching promptly of any changes to your health, medications, injuries, or medical conditions.
If screening identifies an elevated health risk, Lux Coaching may require written medical clearance before services commence.
3. Virtual Coaching Safety
Online coaching carries inherent risks due to the absence of in-person supervision. By participating, you acknowledge and agree that:
You are responsible for ensuring your training environment is safe, appropriate, and free from hazards
You will use suitable equipment, footwear, and space
You will stop exercise immediately if you experience pain, dizziness, faintness, chest discomfort, or unusual symptoms
You will seek medical assistance where appropriate
Lux Coaching is not responsible for technical failures, connectivity issues, or limitations of digital platforms. Live or recorded video does not constitute real-time supervision or emergency monitoring.
4. Client Responsibilities
You agree to:
Follow program instructions safely and as prescribed
Communicate honestly and respectfully
Complete check-ins, tracking, and required tasks where applicable
Take responsibility for your own health and wellbeing
Results vary between individuals and are not guaranteed. Outcomes depend on consistency, adherence, and individual circumstances.
5. Fees, Billing & Payments
Fees are disclosed at the time of purchase or enrolment. Payments are processed via Stripe or other approved payment processors and may be charged as one-off payments or recurring subscriptions.
By subscribing, you authorise Lux Coaching to charge your nominated payment method in accordance with the agreed billing schedule. You are responsible for ensuring payment details remain current.
6. Failed Payments
If a payment fails, Lux Coaching may retry the charge. Access to services may be paused until outstanding payments are resolved. Continued non-payment may result in suspension or termination of services.
7. Minimum Commitment, Cancellations & Pauses
Some services include a minimum commitment period (for example, 12 weeks). Where a minimum term applies, this will be disclosed prior to enrolment and acknowledged in your intake form.
Cancellation requests must be submitted in writing
During a minimum commitment period, early cancellation does not remove the obligation to complete the minimum term payments
After the minimum term, services continue until cancelled with appropriate notice
Pauses or holds are not guaranteed and may be granted at Lux Coaching’s discretion for genuine reasons. A pause does not cancel the agreement and may extend the end date
8. Refunds & Australian Consumer Law
Fees are generally non-refundable except where required under the Australian Consumer Law (ACL). Nothing in these Terms excludes or limits your rights under the ACL, including consumer guarantees relating to due care and skill.
Refunds are not provided for change of mind, non-attendance, partial participation, or failure to follow the program, unless legally required.
9. Couples Coaching
Where services are provided to couples:
Pricing and billing apply per couple as disclosed
Each individual remains personally responsible for disclosures, participation, and safety
Disengagement by one partner does not void the agreement or billing obligations
10. Beta Programs
Beta programs may be offered at reduced rates and may evolve over time. Features, delivery methods, and resources may change as part of service development. Participation in beta programs is voluntary.
11. Intellectual Property
All programs, resources, videos, documents, templates, and educational materials remain the intellectual property of Lux Coaching. Content may not be copied, shared, sold, or distributed without written permission.
12. Privacy & Data Handling
Lux Coaching collects personal and, where applicable, sensitive health information to deliver services. Information may be stored and processed using third-party platforms including Everfit, Stripe, Zoom, Loom, email services, and cloud storage providers.
By using Lux Coaching services, you consent to the collection, use, and storage of your information in accordance with our Privacy Policy and applicable privacy laws. Data may be stored outside Australia depending on platform providers.
13. Records & Retention
Client records, including screening forms and program data, are retained for professional and legal purposes. Records are stored securely and accessed only where required to deliver services or meet legal obligations.
14. Suspension or Termination
Lux Coaching reserves the right to suspend or terminate services if you:
Fail to make payments
Provide false or misleading information
Breach these Terms
Engage in abusive, unsafe, or inappropriate behaviour
Termination due to breach does not entitle you to refunds.
15. Limitation of Liability
To the maximum extent permitted by law, Lux Coaching is not liable for indirect, incidental, or consequential loss arising from participation in services. Exercise participation carries inherent risks, and you participate voluntarily.
Nothing in these Terms limits rights you may have under the Australian Consumer Law.
16. Updates to Terms
Lux Coaching may update these Terms from time to time. Updated Terms will be published on our website. Continued use of services after changes take effect constitutes acceptance.
17. Governing Law
These Terms are governed by the laws of Australia and the applicable laws of your state or territory.
